Terms of Service

These Terms of Service (“Terms”) govern your use of the BrainBloomer website and services (“Service”) operated by Benetti Corporation, a Texas C-Corporation (“we,” “us,” or “our”). By using the Service, you agree to these Terms.

1. Account Registration

You must create an account to use certain features. You are responsible for maintaining the security of your account credentials. You must provide accurate and complete information.

3. BWF Monitoring Service

The BWF player monitoring feature provides tournament position tracking and alerts based on publicly available data from the Badminton World Federation. We do not guarantee the accuracy, completeness, or timeliness of this data. Position data is refreshed periodically and may not reflect real-time changes.

4. Notifications

By opting in to SMS, email, or WhatsApp notifications, you consent to receive messages from us. Standard message and data rates may apply. You can opt out at any time through your account settings or by replying STOP to SMS messages. Reply HELP for support, or contact alerts@brainbloomer.com.

5. Payments, Subscriptions, and Fees

5.1 Payment Processing

All payments are processed through authorized third-party payment processors. By making a purchase, you agree to the applicable payment processor’s terms of service. BrainBloomer does not directly store your payment credentials.

5.2 Content Purchases

One-time content purchases grant access to the purchased content as described at the time of purchase. Content purchases are non-transferable. BrainBloomer reserves the right to modify access terms, delivery methods, and content availability at any time.

5.3 Subscriptions

Subscriptions renew automatically at the then-current rate unless cancelled. You may cancel at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.

5.4 Virtual Credits and Digital Goods

BrainBloomer may offer virtual credits, tokens, or other digital goods that can be used within the platform. These are purchased with real currency and are non-refundable once purchased. Virtual credits and digital goods have no cash value, cannot be exchanged for cash, and cannot be transferred outside the platform. BrainBloomer reserves the right to modify, limit, or discontinue any virtual currency or digital goods program at any time.

5.5 Platform Fees and Revenue Share

BrainBloomer charges platform fees on transactions conducted through the Service. These fees may include percentage-based commissions, flat fees, or other fee structures applied to purchases, subscriptions, digital goods, tips, and any other monetary transactions on the platform.

All platform fees, revenue share percentages, commission rates, pricing structures, and any other charges are subject to change at any time at BrainBloomer’s sole discretion, without prior notice or announcement. The then-current fee schedule applies to all transactions at the time they are processed. Continued use of the Service after any fee change constitutes acceptance of the new fees.

Creators and sellers acknowledge that third-party payment processing fees are separate from and in addition to BrainBloomer’s platform fees. BrainBloomer does not absorb third-party processing fees on behalf of any user.

5.6 Creator and Seller Payouts

Earnings are distributed through authorized third-party payment services. Creators and sellers are solely responsible for setting up and maintaining their payment accounts in good standing with the applicable payment provider. If a creator’s or seller’s payment account is restricted, suspended, under review, or otherwise unable to receive funds for any reason, BrainBloomer reserves the right to continue processing sales of that party’s content and retain the full proceeds until the payment account issue is resolved to BrainBloomer’s satisfaction.

5.7 Refunds

Refund eligibility, timeframes, and conditions are determined by BrainBloomer at its sole discretion. BrainBloomer reserves the right to modify its refund policies at any time. Virtual credit and digital goods purchases are non-refundable. Subscription payments are non-refundable.

5.8 Pricing

Creators may set prices for their content within parameters established by BrainBloomer. BrainBloomer reserves the right to set, modify, or enforce minimum or maximum price thresholds, currency requirements, and pricing rules for any content or service offered on the platform.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by BrainBloomer and are protected by copyright, trademark, and other intellectual property laws.

7. Third-Party Content

BWF player data, tournament information, and related content are the property of the Badminton World Federation. We display this data for informational purposes. Player profile images are served from BWF’s public CDN.

8. Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be accurate or complete.

9. Limitation of Liability

To the maximum extent permitted by law, BrainBloomer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
